Terms of Service

Please read these terms and conditions before using Touch Lebanon App or Touch Website (“The Platform”).

These terms and conditions govern the relationship between you (subscribers/customers) and Mobile Interim Company (2) S.A.L (Hereinafter referred to as “MIC2” or “touch”) as service provider.

You should not install, use or otherwise access “Touch Lebanon App or Touch Website”, if you don’t agree with any of the following terms and conditions. MIC2 reserves the right to modify, alter, change, update and/or add or remove portions of the concerned terms and conditions.

1. Subject to your agreement with the terms and conditions of “Touch Lebanon App or Touch Website”, MIC2 will grant you access to use the services for your own non-commercial purposes.
2. Natural persons (18 and above) as well as registered juridical persons are eligible to install, use or otherwise access “Touch Lebanon App or Touch Website”.
3. Subscribers to “Touch Lebanon App or Touch Website” shall be required to register an account using their mobile numbers and/or Email.
4. You shall be required to select a passcode for your “Touch Lebanon App or Touch Website” account and you are required to not share the account or login information with anyone else access your account.
5. Subscribers of “Touch Lebanon App or Touch Website” must be bound by MIC2 terms and conditions applicable on each particular product/service/promotion/offer, while MIC2 uses reasonable efforts to include accurate and up-to-date information on “Touch Lebanon App or Touch Website”, but it makes no warranties and shall have no liabilities to its accuracy.
6. MIC2 reserves the right to remove or suspend any account at any time and for any reason, including misuse and claims by third parties. MIC2 reserves the right, without prior notice where reasonably required, to suspend, restrict, or terminate access to the Platform if:

a-Suspicious, fraudulent, or unlawful activity is detected;

b-Security risks threaten the Platform or network integrity;

c- Regulatory or governmental instructions require such action;

d-Misuse or breach of these Terms occurs.

MIC2 shall not be liable for any losses resulting from such protective measures taken in good faith to safeguard the Platform, Subscribers, or network operations.

1. You can delete your account at any time by following the process described in the “Touch Lebanon App or Touch Website”.
2. Subscriber warrants that s/he is the sole and beneficial owner of the mobile telephone handset/PC/Laptop…etc. containing “Touch Lebanon App or Touch Website” and will indemnify MIC2 against all losses, damages, claims, demands, costs and charges arising out of the breach of “Touch Lebanon App or Touch Website” Terms and Conditions. MIC2 shall not be held responsible for misuse of any credit/debit card.
3. MIC2 shall have the right to discontinue all or parts of the services or otherwise update, change and/or modify terms and conditions of the relevant products/services/promotions/offers from time to time.
4. Subscriber shall not use the “Touch Lebanon App or Touch Website” in any manner which could damage, disable or impair any MIC2 services or the network(s).
5. Online payments must be permitted by your respective bank on your credit/debit card and international credit/debit cards for making financial transactions/payments through “Touch Lebanon App or Touch Website”.
6. The Platform may rely on or integrate services provided by third parties including banks, payment gateways, telecommunications infrastructure providers, internet service providers, and external software vendors. MIC2 shall not be responsible for:

e-Failures or delays caused by third-party systems,

f- Banking authorization decisions,

g-Payment processing interruptions,

h-Internet connectivity issues,

i- External cybersecurity incidents beyond MIC2 reasonable control.

j- Any dispute related to third-party services shall be addressed directly with the concerned third party where applicable.

1. To make the service better, you agree to MIC2 - Mobile Interim Company (2) contacting you via your contact information shared with MIC2 - Mobile Interim Company (2) for feedback. You also agree to MIC2 sharing of this contact information with third party service providers as and when required.
2. MIC2 does not guarantee any specific response time for “Touch Lebanon App or Touch Website” accessing to Internet.
3. MIC2 shall not be liable for any delay or failure to perform resulting from causes outside the reasonable control of MIC2 - Mobile Interim Company (2), including without limitation any failure to perform hereunder due to unforeseen circumstances of cause beyond MIC2’s control such as war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes or shortages of transportation facilities, fuel, energy, labor or materials.
4. MIC2 shall not be held responsible for sharing of balance and/or making financial transactions to anyone through “Touch Lebanon App or Touch Website”.
5. MIC2 will not be responsible against any unexpected system failure/service unavailability.
6. All intellectual property rights related to the “Touch Lebanon App or Touch Website”, and all associated content, software, databases, interfaces, designs, graphics, logos, trademarks, service marks, texts, images, audio, video materials, and underlying technology (collectively the “Platform Content”) are and shall remain the exclusive property of MIC2, its licensors, or authorized partners.
7. Subject to compliance with these Terms and Conditions, MIC2 grants the Subscriber a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for personal, lawful, and non-commercial purposes.

The Subscriber shall not, without prior written consent from MIC2:

a-Copy, reproduce, distribute, publish, transmit, display, sell, license, or commercially exploit any part of the Platform;

b-Modify, reverse engineer, decompile, disassemble, or attempt to derive the source code of the Platform;

c- Remove or alter any copyright, trademark, or proprietary notice;

d-Create derivative works based on the Platform Content;

e-Use the Platform in any manner that infringes MIC2 intellectual property rights or those of third parties.

f- Unauthorized use of the Platform or Platform Content may constitute a violation of applicable intellectual property laws and may result in civil and/or criminal liability.

g-Nothing contained in these Terms and Conditions shall be construed as transferring ownership of any intellectual property rights to the Subscriber.

1. By installing, accessing, registering, or using the “Touch Lebanon App” or the “Touch Website”, the Subscriber acknowledges and agrees that:

a-All electronic communications, notifications, confirmations, records, invoices, requests, transactions, and approvals generated through the Platform shall have full legal force and evidentiary value, in accordance with applicable Lebanese laws governing electronic transactions and electronic signatures.

b-The Subscriber agrees that MIC2 may rely on electronic authentication methods, including but not limited to:

·  Mobile number verification,

·  Email address verification

·  Passwords or passcodes,

·  One-Time Passwords (OTP),

·  Biometric authentication where available as sufficient proof of identity and authorization

c- The Subscriber acknowledges responsibility for all actions performed through their registered account unless prior written notification of unauthorized access has been submitted to MIC2 without undue delay.

d-The Subscriber agrees to receive contractual notices, service communications, billing information, and legal notifications electronically via the Platform, SMS, email, or other digital channels approved by MIC2

1. In case of dispute, the above mentioned Terms and Conditions shall be governed by Lebanese laws and disputes shall fall under the exclusive jurisdiction of Beirut Courts.
